These Terms of Use (“Terms”) govern your access to and use of websites, ecommerce pages, forms, and online services operated by PROTOTYPE 3D (“PROTOTYPE 3D,” “we,” “us,” or “our”), including any content, functionality, and services offered thereon (collectively, the “Site”).
By accessing or using the Site, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Site.

1) Who We Are & What We Do
PROTOTYPE 3D designs and manufactures made-to-order and small-batch 3D-printed furniture, interiors, sculptures, and architectural components. Because many items are customized, the policies below address deposits, changes, cancellations, tolerances, and returns specific to custom work—consistent with common practices among small studios producing to spec.
2) Changes to These Terms
We may update these Terms at any time. Changes take effect when posted to the Site. Continued use after changes means you accept the revised Terms.
3) Eligibility & Your Account
You must be the age of majority in your province/state (or have parental/guardian consent) to use the Site or place orders. You’re responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
4) Quotes, Orders, Deposits & Lead Times (Made-to-Order)
Quotes. Quotes/estimates are valid for the period stated on the quote (or 14 days if not stated).
Deposits. Custom orders typically require a non-refundable deposit to secure materials and production time.
Approval. Drawings/specs/renders must be approved in writing before fabrication.
Changes. Post-approval changes may affect price and lead time; additional charges may apply.
Lead Times. Lead times are estimates, not guarantees. We’ll keep you updated and mitigate delays.
Cancellations. Because items are made to order, cancellations after approval/production start are generally not permitted. If allowed at our discretion, you’re responsible for work/materials to date.
5) Materials, Tolerances & Finishes (Additive Manufacturing)
Material Characteristics. Layer lines, minor surface texture, and slight colour/finish variation are inherent to large-format 3D printing and recycled/bio-based polymers; these are not defects.
Tolerances. Dimensional tolerances typical for large-format polymer printing apply unless otherwise agreed in writing for a specific project.
Colour/Display. We try to depict finishes accurately, but device displays and batch-to-batch polymer variation mean exact matches aren’t guaranteed.
Care/Use. Follow our care guides. Certain products are intended for indoor use unless explicitly specified as outdoor-rated.
6) Shipping, Delivery & Risk of Loss
Inspection. Please inspect shipments upon delivery. Note visible damage on the carrier’s paperwork and photograph it.
Risk Transfer. Title and risk of loss transfer upon delivery to the shipping carrier or, for local delivery/installation, upon drop-off/completion.
Storage Fees. If delivery/installation is delayed due to site readiness or your request, storage or redelivery fees may apply.
7) Returns & Exchanges
Custom/Made-to-Order. Because items are made to your specifications, all custom orders are final sale and not eligible for return or exchange unless required by law or covered by our warranty.
Stock Items (if applicable). If we offer stock items, return eligibility and timelines will be stated on the product page or order confirmation.
8) Limited Warranty
Most products include our Limited 1-Year Manufacturer’s Warranty covering materials performance and craftsmanship under normal use (structural integrity; significant defects in material or assembly). Normal wear, finish changes from environment/UV, misuse, improper installation, or third-party modifications are excluded. For full details, see our separate Warranty document. Warranty claims require proof of purchase and photos.
9) Pricing, Taxes & Availability
Prices are shown in the currency indicated on the Site and exclude taxes, shipping, duties, and fees unless stated. We may correct errors (including pricing/availability) and cancel/refund orders impacted by such errors prior to shipment.
10) Intellectual Property & Use of the Site
Our IP. The Site and all content (text, graphics, images, logos, renders, videos, CAD/exploded views, and documentation) are owned by PROTOTYPE 3D or its licensors and protected by Canadian, U.S., and international IP laws.
Limited License. We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Site for personal or internal business purposes. You may not copy, modify, distribute, reverse engineer, or create derivative works from the Site or its content without our written permission.
Customer Files. Files you provide for quoting or fabrication (e.g., drawings, CAD, models) remain your IP. You grant us a limited license to use those files solely to evaluate, quote, manufacture, install, and service your order. We treat such files as confidential and do not share them publicly without your permission (except as required by law or to subcontractors under confidentiality obligations).
11) User Content (Testimonials, Photos)
If you voluntarily submit reviews, photos, or testimonials about our products or installations, you grant us a non-exclusive, royalty-free license to use, reproduce, and publicly display that content (including your first name/company name and city) for marketing our work, unless you notify us in writing that we may not do so.
12) Third-Party Links & Tools
The Site may link to third-party websites or use embedded tools (e.g., payment processors, 3D viewers). We’re not responsible for third-party content or practices. Your use of third-party services is governed by their terms and privacy policies.
13) Prohibited Uses
You agree not to: (a) violate laws or regulations; (b) attempt to gain unauthorized access to the Site or interfere with its operation; (c) upload malicious code; (d) infringe IP or privacy rights; or (e) use the Site to develop or train competing models/solutions scraping our content without permission.
14) Privacy
Your use of the Site is also governed by our Privacy Policy, which explains how we collect, use, and safeguard personal information in Canada and the United States.
15) Disclaimers
EXCEPT AS EXPRESSLY SET OUT IN OUR WRITTEN WARRANTY, THE SITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL OTHER WARRANTIES AND CONDITIONS, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. RENDERS AND PHOTOS ARE ILLUSTRATIVE; FINAL PRODUCTS MAY VARY WITHIN ACCEPTED MANUFACTURING TOLERANCES.
16) Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PROTOTYPE 3D WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS/REVENUES, ARISING OUT OF OR RELATED TO THE SITE, YOUR ORDER, OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO A PRODUCT IS LIMITED TO THE AMOUNT YOU PAID FOR THAT PRODUCT.
(Some jurisdictions do not allow certain limitations; in those places, we limit our liability to the minimum extent permitted by law.)
17) Indemnity
You agree to indemnify and hold PROTOTYPE 3D harmless from claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from your misuse of the Site, violation of these Terms, or infringement of any third-party rights.
18) Copyright Concerns (Canada/U.S.)
If you believe content on the Site infringes your copyright, please email hello@prototype3d.ca with: (a) your contact info; (b) identification of the work claimed infringed; (c) identification/URL of the allegedly infringing material; (d) a statement of good-faith belief; and (e) your signature (physical or electronic). If we remove content, the uploader may submit a counter-notice with a statement under penalty of perjury that removal was in error. We may restore the material unless we receive notice of legal action within the applicable timeframe. We may disable accounts of repeat infringers.
19) Governing Law & Venue
These Terms and any dispute relating to the Site, an order, or our products are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict-of-law rules. You agree to the exclusive jurisdiction and venue of the courts located in British Columbia, Canada.
20) Force Majeure
We are not liable for delays or failure to perform caused by events beyond our reasonable control (e.g., supply disruptions, carrier delays, strikes, emergencies, natural disasters).
21) Miscellaneous
If any provision is held unenforceable, it is severed and the remainder continues in effect. Our failure to enforce a provision is not a waiver. You may not assign your rights without our consent; we may assign in connection with a merger, acquisition, or sale of assets.
